How Do I Get an Uncontested Divorce in Alabama

If both parties have reached an agreement on all marital issues, then you can get an uncontested divorce in Alabama. An agreement on marital issues includes property division, custody, child support, marital debts, retirement accounts, and anything else that needs to be resolved. An uncontested divorce is the simplest and quickest way to get a divorce in Alabama.

To do an uncontested divorce in Autauga County or wherever you live, the first thing is to talk to your spouse and reach an agreement. Once an agreement is reached, you can then pay a divorce attorney a low flat fee and have them prepare your paperwork to be signed by both of you and filed with the Court.

It is important to have a local divorce lawyer file your uncontested divorce since they need to know what the judges like in the paperwork. Everything can be done online and there is no need to miss work at all in most cases since you and your spouse are doing all of the hard work of reaching an agreement yourself. In an uncontested divorce, a divorce attorney can usually do a phone or video consultation. Therefore, there is usually not any requirement to meet in person at their office.

Your Alabama uncontested divorce is mostly paperwork. Both spouses need to sign, execute, and return the paperwork for the law office to file the uncontested divorce. Once the divorce attorneys get the paperwork, then they file the divorce online. You can get your uncontested divorce decree about a month or two later. There is no court as long as your agreement is approved by the judge. Unless you are doing something unusual or if it is something not in the best interest of the children, the agreement should be approved.

This is possible due to both of you having signed a written contractual agreement. There is nothing for a judge to decide since the two of you have already decided everything by agreement. If all of your paperwork has been prepared and signed in accordance with the local rules of the County Court, then the Judge will sign your divorce decree. You can get a quick divorce since it was prepared correctly and has been signed by both parties. Alabama allows for these easy uncontested divorces as long as the proper protocols are followed.

In conclusion, navigating the process of an uncontested divorce can simplify your path to a fresh start. By understanding the necessary steps and gathering the required documents, you can achieve a smoother transition. Remember, an uncontested divorce in Alabama not only saves time but also reduces stress for both parties involved.
